What is the Free Property Estimate?

The Free Property Estimate (Estimate) is intended to provide general information only and is not in the nature of advice or a recommendation to you. It is generated on a fully automated and algorithmic basis and relies on third-party data (including data sourced from PropTrack) (Third Party Data). As a result, HTW cannot guarantee that the Estimate is accurate, current or complete. The Estimate is not a substitute for appropriate advice tailored to your specific circumstances. It is provided at no cost to you by Herron Todd White (HTW).

What the Free Property Estimate is NOT

The Free Property Estimate is not a professional valuation, assessment or advice. In particular:

• It is not prepared or reviewed by a qualified valuer.

• No physical inspection of the property has been conducted.

• No assessment of the property's condition, improvements or features has been made.

• It is based on publicly available data which may be incomplete, delayed or inaccurate.

Not Suitable for Formal Purposes

The Free Estimate is NOT suitable for use as a formal valuation for taxation (including CGT cost base or depreciation), legal, financial, lending or any other professional purpose.

The Estimate is general information only. Subject to the consumer guarantees under the Australian Consumer Law (Consumer Guarantees), HTW does not warrant or represent that the Estimate is suitable for any particular purpose, including for taxation (including CGT cost base or depreciation), legal, financial, lending or any other professional purpose. You should not rely on the Estimate for any such purpose.

Limitation of Liability

Subject to the Consumer Guarantees, HTW accepts no liability in connection with the Free Estimate to the extent permitted by law.

To the maximum extent permitted by law, and subject to the Consumer Guarantees, neither party is liable to the other for any indirect, consequential or special loss or damage, including (without limitation) loss of profit, loss of opportunity, loss of expected savings or benefits, loss of revenue, loss of goodwill, or loss or corruption of data, arising out of or in connection with the Free Estimate.

Your Consumer Rights

Nothing in this disclaimer excludes, restricts or modifies any Consumer Guarantee.

Under the Australian Consumer Law, services come with Consumer Guarantees that cannot be excluded. If HTW fails to comply with a Consumer Guarantee, you may be entitled to a remedy, including compensation or damages.
